² Functional barrier / secondary indirect labelling — A Declaration of Compliance for food packaging is not required where the package acts as a functional barrier (e.g. glass or aluminium) or for secondary indirect labelling (e.g. a label applied to a carton containing packaged product). The packer or brand owner retains final responsibility for ensuring the complete packaging conforms to Regulation (EU) No. 10/2011, national legislation for papers, and Regulation (EC) No. 1935/2004. Note: substances that are mutagenic, carcinogenic, toxic to reproduction, or involve new technologies such as nanoparticles are not covered by the functional barrier concept.
